(5) After the evidence which has been given, and the distinctly expressed opinion of our Magistrates, I consider that the Chinese Government have just cause for complaint in our hesitation to act up to our treaty engagements, and in our procrastination in delivering up the prisoners to be tried by the laws of their own country.
(b.) Lord Derby reserved for himself the right of confirming the decision, and with all the facts shown "on the face of the proceedings," I believe he would have been glad of the support of the Council, should he decide on surrendering the prisoners.
